1. By signing up to be an Affiliate in the tradomed.org Affiliate Program (Program) you are agreeing to be bound by the following terms and conditions (Terms of Service), that;

a. tradomed.org reserves the right to update and change the Terms of Service from time to time, with or without notice. Any new feature that augments or enhances the current Program, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Program after any such changes shall constitute your consent to such changes.

b. Violation of any of the terms below will result in the suspension or termination of your Account and/or for forfeiture of any outstanding affiliate commission payments earned during the violation.

2. Terms of service

a. You must be 18 years and above to use this website.

b. You must not use this website to commit any form of fraud against TradoMed, fellow affiliates and members of the public.

c. You must not malign TradoMed anywhere; online or on ground: in writing or speech.

d. You must use the appropriate channel of communication to approach the admin of tradomed.org to resolve any issue that may arise.

e. You must be an active member with business activities happening regularly in your personal office.

f. You must not promote any other similar affiliate program.

3. Relationship of Parties

You and we are independent contractors, and nothing in this Terms of Service will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this document.

4. Acknowledgement & acceptance of Terms of Service

These Terms of Service currently apply but may be amended or edited from time to time. Please read these Terms of Service carefully before you use this website. By using this website, you expressly agree to be bound by these Terms as they now are or as amended or edited from time to time and acknowledge that you have read, understood and accepted them. You shall immediately notify TradoMed of any unauthorized use of these Identifiers, or any other breach of security. You are fully responsible for all activities that occur under these Identifiers. TradoMed is not responsible for any misuse of your account by someone who uses your Identifiers.

17. Termination

You agree that TradoMed, in its sole discretion, may terminate your password, account (or any other part thereof) or use of the service, and remove and discard any content within, for any reason, including, without limitation, for lack of use or if TradoMed believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service.

18. Survey and Questionnaires

tradomed.org may contain several optional surveys and questionnaires throughout the site asking for information. We use the information you provide to help customize your shopping experience, showing you the content we believe you might be interested in, in order of your reference, as well as to provide advice and purchase recommendations.

As a condition to your participation in the Program, you agree that while you are a Program participant you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority that has jurisdiction over you, whether those laws, etc. are now in effect or later come into effect during the time you are a Program participant. Without limiting the foregoing obligation, you agree that as a condition of your participation in the Program you will comply with all applicable laws (federal, state or otherwise) that govern marketing email, including without limitation, the CAN-SPAM Act of 2003 and all other anti-spam laws.

23. Arbitration

Any dispute relating in any way to this Agreement (including any actual or alleged breach hereof), any transaction or activity under this Agreement or your relationship with us or any of our affiliates shall be submitted to confidential arbitration, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court (and you consent to non-exclusive jurisdiction and venue in such courts) or any other court of competent jurisdiction. Arbitration under this agreement shall be conducted under the rules then prevailing of the English Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Terms of Service shall be joined to an arbitration involving any other party subject to this Terms of Service, whether through class arbitration proceedings or otherwise.
